Resumo
Este artigo aborda a vitimização no Direito Penal brasileiro, com ênfase na vitimização secundária. A pesquisa tem como objetivo analisar as políticas públicas voltadas ao atendimento das pessoas vitimadas, considerando os aspectos sociológicos e históricos do tema. Para tanto, foram realizadas análises documentais e bibliográficas, com destaque para a evolução dos Direitos Humanos e Fundamentais no âmbito jurídico do Direito Penal e na evolução da vitimologia, bem como na abordagem dos diferentes tipos de vitimização e de que forma elas ocorrem. Em paralelo, questionasse o foco do aparato estatal e no respaldo que as vítimas recebem do poder público. Por conseguinte, em análise objetiva, os resultados apontam que a vitimização secundária, especificamente, é um fenômeno comum no sistema jurídico-penal brasileiro, mas a melhoria das políticas públicas pode minimizar os seus impactos negativos. Sobretudo no que cabe a capacitação profissional e na implementação de pesquisas cientificas voltadas para a supracitada temática, de forma contínua, para acompanhamento e o estreitamento do real custo da vitimização no país.
This article addresses victimization in Brazilian Criminal Law, with an emphasis on secondary victimization. The research aims to analyze public policies aimed at assisting victims, considering the sociological and historical aspects of the subject. To this end, documental and bibliographic analyzes were carried out, with emphasis on the evolution of Human and Fundamental Rights in the legal scope of Criminal Law and on the evolution of victimology, as well as on the approach to the different types of victimization and how they occur. In parallel, the focus of the state apparatus and the support that the victims receive from the public power are questioned. Therefore, in an objective analysis, the results indicate that secondary victimization, specifically, is a common phenomenon in the Brazilian penal legal system, but the improvement of public policies can minimize its negative impacts. Especially with regard to professional training and the implementation of scientific research focused on the aforementioned topic, on an ongoing basis, to monitor and narrow the real cost of victimization in the country.
